Job Overview

NVIDIA is a pioneer in GPU-accelerated computing, specializing in products and platforms for gaming, professional visualization, data center, and automotive. We are seeking a China Labor Counsel to advise on labor disputes, handle arbitrations, and provide guidance on labor law inquiries from China & HK employees, HRs, and business teams.

Key Responsibilities

  • Advise on labor disputes, arbitrations, and litigations, and handle potential labor disputes proceedings.
  • Provide guidance on labor law inquiries from China & HK employees, HRs, and business teams, including non-competition related inquiries.
  • Review, improve, and update labor-related policies to ensure high-level compliance and provide relevant training to employees, HRs, and managers.
  • Address HR daily matters, such as work-related injury case reviews, sick leave arrangements, retirement age inquiries, background check record reviews, prior invention and outside activity disclosure reviews, and employment contract template reviews.
  • Participate in PIP meetings, document reviews, and result deliveries to mitigate risk for potential labor disputes.
  • Advise on employment termination cases due to performance issues, serious policy violations, and prepare relevant documentations.
  • Collaborate with HQ investigation teams for internal investigations on employees' misconduct cases and draft warning letters.
  • Perform random legal research for global employment compliance purposes.

Requirements

  • A law degree from a top China law school, LLM/JD preferred but not required.
  • 7+ years' legal experience from international law firms, reputable China law firms, or MNCs.
  • Qualification to practice law in China and a Chinese lawyer certificate.
  • Labor arbitrator experience preferred but not required.
  • Verbal and written fluency in Chinese/Mandarin and English for negotiations, agreement/document review, research, and drafting.
  • Rich experience in handling labor arbitrations, litigations, and independently handling labor disputes proceedings.
  • Knowledge of dealing various employment issues under China and HK laws and internal investigations.
  • Deep knowledge, insight, and experience in non-competition cases and providing practical advice to business teams.
  • Self-education and updating the legal team on relevant labor laws and regulations.
  • Good presentation skills for engaging discussions with HR and business teams.
  • Appetite to make risk-benefit analysis judgments and recommendations.
  • Highest ethics and integrity, with a willingness to publicly resist internal and external business influence.
  • Stability and strong interpersonal (EQ) skills, with a team player attitude.
