Key Responsibilities:

  • Provide expert guidance on labor disputes and manage potential labor arbitrations and litigations independently.
  • Address daily labor law inquiries from employees in China and Hong Kong, HR teams, and business units, offering insightful advice to facilitate business operations. This includes providing strategic advice on non-competition matters, streamlining case assessment processes, and delivering actionable guidelines to HR personnel and management.
  • Review, enhance, and update HR policies related to labor to ensure high compliance standards, while also providing relevant training for employees, HR teams, and managers.
  • Handle daily HR issues such as work-related injury assessments, sick leave arrangements, retirement age inquiries, background check evaluations, and reviews of prior inventions and outside activities. Regularly assess employment-related contract templates and amendments, and review HR service contracts with various vendors.
  • Play a significant role in Performance Improvement Plan (PIP) meetings, document evaluations, and result communications in collaboration with HR to mitigate risks associated with potential labor disputes.
  • Advise on employment termination cases related to performance issues or serious policy violations, prepare necessary documentation, and engage in negotiation strategy discussions with HR.
  • Collaborate with the headquarters investigation team on internal inquiries regarding employee misconduct, drafting necessary warning letters.
  • Conduct legal research as required by headquarters for global employment compliance purposes.

Qualifications:

  • A law degree from a prestigious Chinese law school; an LLM or JD is preferred but not mandatory.
  • A minimum of 7 years of legal experience from international law firms, reputable Chinese law firms, or multinational corporations.
  • Must be qualified to practice law in China and possess a valid Chinese lawyer certificate.
  • Experience as a labor arbitrator is preferred but not essential.
  • Proficient in both Chinese/Mandarin and English, with strong verbal and written communication skills for negotiations, document reviews, research, and drafting.
  • Extensive experience in managing labor arbitrations and litigations, with the ability to independently navigate labor dispute proceedings and provide assessments and case updates to business teams and management.
  • In-depth knowledge of various employment issues under Chinese and Hong Kong laws, along with experience in internal investigations.
  • Strong understanding and experience in non-competition cases, capable of providing practical advice to business teams.
  • Self-motivated with the ability to continuously educate and update the legal team on relevant labor laws and regulations. Resourceful and independent, particularly in work processing and document management.
  • Excellent presentation skills to effectively engage in discussions with HR and business teams, with a keen ability to conduct risk-benefit analyses and make informed recommendations.
  • Uphold the highest standards of ethics and integrity, demonstrating a willingness to resist inappropriate internal and external business influences. Possess strong interpersonal skills and be a collaborative team player.
