We are dedicated to developing effective solutions and nurturing positive relationships with governmental bodies to enhance our operations in China. To support our expanding needs related to HR legal inquiries, we are looking for a skilled Labor Counsel to join our dynamic team.

Key Responsibilities:

  • Provide expert guidance on labor disputes and manage potential labor arbitrations and litigations independently.
  • Address daily labor law inquiries from employees in China and Hong Kong, offering practical advice to facilitate business operations, including insights on non-competition matters and streamlining case assessment processes.
  • Review and enhance HR policies related to labor, ensuring compliance and providing necessary training for employees, HR personnel, and management.
  • Handle various HR-related issues, including assessments of work-related injuries, sick leave arrangements, retirement age inquiries, and reviews of employment contracts and vendor agreements.
  • Participate extensively in performance improvement plan meetings, collaborating with HR to mitigate risks associated with potential labor disputes.
  • Advise on employment termination cases, preparing documentation and engaging in negotiation strategies with HR.
  • Work alongside the headquarters investigation team on internal misconduct investigations, drafting necessary warning letters.
  • Conduct legal research as needed to ensure global employment compliance.

Qualifications:

  • A law degree from a prestigious Chinese law school; LLM/JD is a plus but not mandatory.
  • Over 7 years of legal experience in international law firms, reputable Chinese law firms, or multinational corporations.
  • Qualified to practice law in China and possess a valid Chinese lawyer certificate.
  • Experience as a labor arbitrator is preferred but not essential.
  • Fluency in both Chinese/Mandarin and English for effective negotiations, document reviews, and drafting.
  • Proven track record in managing labor arbitrations and litigations, with the ability to independently navigate labor dispute proceedings.
  • Comprehensive knowledge of employment issues under Chinese and Hong Kong laws, along with experience in internal investigations.
  • In-depth understanding of non-competition cases, providing practical advice to business teams.
  • Self-motivated and resourceful, with a commitment to keeping the legal team updated on relevant labor laws and regulations.
  • Strong presentation skills and the ability to engage in meaningful discussions with HR and business teams, making informed risk-benefit analyses.
  • Exemplary ethics and integrity, with a commitment to resisting inappropriate influences in business. Strong interpersonal skills and a collaborative team player.
